WHY KABALIKAT CHAPTERS IN BICOL DECIDED TO FORM ITS OWN ORGANIZATION

CHRONOLOGICAL ORDER OF EVENTS
WHICH RESULTED TO THE SEPARATION
OF 47 OF THE 54 CHAPTERS IN THE BICOL REGION

Mr. Gil de la Torre, founder and national president of KABALIKAT CIVICON, INC. (this is the actual registered name with the SEC) is a dictator.  He runs the organizations as if its his own private corporation where he appoints the regional governors

NO national election for the past 10 years (He wants to be the national president for life)
NO national assembly
In 1996, Mr. Dela Torre thru Gumaca and Tagkawayan Chapters in Quezon organized another Ragay Chapter, thus, Ragay has 2 chapters  KB Charity 300 which was organized by KB 30 (Naga City Chapter) and KB 174.  Although, Mr. Jennis Nidea, then KB30 Chapter President fought it out with the "powers that be" TO HAVE ATLEAST RESPECT AND COURTESY TO EXISTING CHAPTERS NEAREST TO THE SAID but to no avail. They argued that the national president has the power to organize chapter.  Section 5, Article 17 of the KB national Charter Code: "No other chapter shall be established in area where there is an existing chapter EXCEPT IF THE SAME SHALL BE CHARTERED BY THE FOUNDER/NATIONAL PRESIDENT.

Members of National Executive Council (NEC) or the Regional Governors are all appointed by the Mr. dela Torre.  However, starting in 1999, with the permission of Mr. de la Torre, the Bicol Regional Coordinating Council (RCC) was formally organized and elected its first Regional Governor. The appointed RG, Mr. Archimedes Salvino, won the election.

Sometime during the term of Mr. Salvino, an internal problems among members of KB139 (Daet, Cam. Norte) erupted, instead of solving the problems; Mr. Dela Torre allowed one faction to organize themselves into another chapter -- Kabalikat Charity 105 which was chartered on December 2000.  The problem was:  said KB 105 did not recognize the authority of the Bicol REC as they directly reporting to the national president nor the Bicol REC recognizes KB105.

In 2001, due to his workload, the elected RG stepped down and appointed Mr. Rod Vicaldo, then the Chairman of the Cam Sur Provincial Coordinating Council (PCC), as acting RG.



During Vicaldo’s reign, they drafted the KB Bicol Policy Guidelines in order to remedy the situation (the putting-up of another KB chapter in an area even when there is an existing one).

On March 9, 2002, during the Kabalikat Regional Assembly in Calabanga, Camarines Sur which was attended by Mr. Dela Torre, the KB Bicol Policy guidelines was unanimously approved which provides among others:

Article VIII
Section 1: "Any prospective chapter within the region (Bicol) seeking to be recognized shall apply for endorsement from their respective PCC thru a letter of intent of the sponsoring member-chapter addressed to the RG."

Section 3.  All member-chapters within the vicinity of the petitioning chapter shall have an equal opportunity to sponsor the latter.  However, if several chapter-members signify interest, the issue shall be settled thru drawing of lots, the mechanics of which shall be agreed by the parties concerned.

When KB222 (Tabaco City Chapter) President and Albay PCC Chairman Roberto Montero presented the same to Mr. dela Torre who at that time was on the presidential table together with Acting Gov. Vicaldo and the incumbent Gov (on-leave) Salvino and the other regional officers and PCC Chairmen, he DECLARED HIS APPROVAL TO THE SAME AND AFFIXED HIS SIGNATURE. Said memorable event was witnessed by the regional assembly.

On March 30, 2003, a regional assembly was held in Bulan, Sorsogon with the main agenda: ELECTION OF OFFICERS IN ACCORDANCE with the KB Bicol Policy Guides. Mr. Vicaldo was elected RG who will serve for 2 years  from January 1, 2003 to December 31, 2005.  

ARTICLE IX  MEETINGS
Section 1.  There shall be a semestral regular meeting every year to be held every first Saturday of March and October. . . . .

However from the time he was elected on March 30, 2003 until March 24, 2006, Mr. Vicaldo did not call for a regional officers meeting and regional assembly except on May 2003, a special officers meeting was called to discuss the preparation for a Boy Scout regional jamboree in Sorsogon and in August, 2003 to hold a dialogue with the Quezon PCC officers, re: National Convention on October, 2003 in Lucena City.  (Please take note that the said convention was originally scheduled on April, 2003
But due to the 3 typhoons that hit Luzon, said national convention was reset to January 9-11, 2004.

However, on December 8, 2003 in an occasion of KB 139 in Daet, Camarines Norte, Mr. Dela Torre announced the cancellation of the National Convention in Lucena without informing all chapters nor consulted the host -- the Quezon PCC.

On January 2004, Gov. LRay Villafuerte thru then PDCC Executive Director Mario General, as a token of gratitude to the assistance of KB PCC (Mr. Nidea as Provincial Chairman) during the typhoons which hit the province towards the end of 2003, donated 100 pcs of sweatshirts/KB Uniforms printed with (front: BIG 142 for the 78 [thank you very much for the assistance] KABALIKAT.  Back: FROM THE PEOPLE OF CAMARINES SUR & GOV. LRAY VILAFUERTE).  Said uniforms was intended for use during the opening ceremonies of the scheduled National Convention at Lucena City on January 9  11, 2004

On January 11, 2004, Mons. Jose Roxas of the Immaculate Conception Parish requested us to assist his Parish during the Ati-atihan procession.

Without thinking of politics, Mr. Nidea distributed said uniforms to KB members who served in the operation.

THAT WAS A BIG BLUNDER as it was found later that the participants of the said procession were the LGU of Naga and with of Mayor Robredo and the city and barangay officials.

Mayor Robredo was so mad that on February 2, 2005 he wrote Mr. Dela Torre asking permission to organize a KB chapter composed of city hall employees.  Said letter was personally handled by Robredo to dela Torre who immediately approved the same and on Feb. 10, the latter issued a memo to Mr. Vicaldo to assist the city government in organizing the chapter.  On March 16, 2005, a chapter, what is known now as KB 645 was established without passing through the process in accordance with the provisions of the KB Bicol Policy Guides.

Efforts made by KB 30 thru Chapter president Engr. Jaime  Kalaw and Mr. Nidea by having a dialogue with Vicaldo and Mr. Nathan Sergio of the city hall, but to no avail.  Mr. Nidea even texted Mayor Robredo about the existence of said policy guides.

In the morning of April 22, 2005, KB30 held a joint meeting of executive officers and the BOD and passed 3 resolutions.

RESOLUTION NO. 01

"A resolution not recognizing a group named Kabalikat Naga Central seeking to become a Kabalikat Chapter without passing through the process in accordance with the rules set forth by the Kabalikat Civicom Regional Coordinating Councils (KB-RCC/Bicol."

RESOLUTION  NO. 02

A resolution urging the Kabalikat Civicom national Executive Council  headed by the Dela Torre to respect the KB Bicol Policy guidelines and to give due courtesy and esteem to existing KB chapter prior to the organization of another chapter"

RESOLUTION NO. 03

"A resolution expelling the 13 members of KB30"

In the afternoon of April 22, 2005, a regular meeting of PCC Cam. Sur was held and approved a resolution:

RESOLUTION NO. 01

"A resolution enjoining all chapter-members of the KB-PCC/Cam. Sur not to recognize any group seeking to become a kabalikat chapter within the province of Cam. Sur without passing thru the usual process set forth by the KB Bicol."

On February 2, 2006, issued an unnumbered memorandum to Mr. Salvino, an expelled member of KB30 (and a tuta ni dela Torre)  thru Mr. Vicaldo to Streamline KB30. . .

On February 20, 2006, KB30 President Kalaw sent a letter to Dela Torre in response to his memo of Feb 2.

On March 1, 2006, Mr. Salvino called a meeting on April 8, 2006 to reorganize KB30 with a threat to delete the names from the roster of membership if they fail to attend.

On April 3, 2006, Mr. Kalaw distributed a letter to KB 30 members calling for a general assembly meeting on April 7, 2006.  Said meeting was attended by 68 members.  The body also unanimously approved the 3 resolutions of the joint executive officers and BOD on April 22, 2005.  The body also agreed to host, in cooperation with the CSur PCC, a regional fellowship on March 24, 2006 since there are members coming from other provinces who will participate in Palarong Bicol which will be hosted by LGU Naga.  At t

March 24, 2006, during the Palarong Bicol in Naga, KB30 headed by Engr. Jaime Kalaw, Jr, in cooperation with the CSur PCC headed by Nidea hosted a KB regional fellowship at the BSP Office.  Said gathering was attended by more than 100 members coming from 24 chapters in the region.  After dinner, Sorsogon Provincial chairman suggested that the said gathering be converted into a regional assembly since majority of the chapters are represented.  Nidea, being the host provincial chairman gathered all the members and announced the suggestion of Sorsogon.  The body unanimously agreed.  

Since the term of office of the regional officers was supposed to end on Dec. 31, 2005, a motion presented by Cam. Norte to declare all positions vacant in the RCC was unanimously approved and immediately held an election

Nidea won unopposed as Regional Governor.

On March 25, 2006 (less 12 hours after the alleged commission of violation), Vicaldo as approved by the Regional Executive Council issued an expulsion for Mr. Nidea and the expulsion of KB30 Chapter and deletion from the KB Regional list.. THE TRUTH IS THE COMPOSITION OF THE REC OR RCC ARE PCC CHAIRMEN.  ALL THE PCC CHAIRMEN ATTENDED AND PARTICIPATED THE MARCH 24 MEETING.

On March 26, 2006 (again in less 12 hours after they were supposed to be furnished of a copy of the March 25 expulsion), the national executive council thru dela Torre issued an expulsion order for Nidea. GRABE, MGA SUPERMEN AN MGA REGIONAL GOVERNORS PARA MAGKATIRIPON TOLOS SA MANILA.

On April 10, 2006, a regional consultation which was attended by the 5 PCC Chairmen was held in Ligao City.  The body approved the following:

o to hold Regional assembly on April 29, 2006 to be hosted by KB Ligao
o to submit to the said regional assembly the proposed independent Kabalikat Bicol with a new name as KABALIKAT CIVIC COMMUNICATORS NETWORK OF BICOL, INC. (KABALIKAT CIVICOM BICOL) for approval.
o To submit the draft constitution and by laws  for approval
o To hold election for the regional officers

On April 29, 2006, the regional assembly unanimously approved to sever its ties with the Mr dela Torre and declared an independent Bicol by naming its new group as KABALIKAT CIVIC COMMUNICATORS NETWORK OF BICOL, INC. (KABALIKAT CIVICOM BICOL).

SEC-Legaspi issued its registration on May 18, 2006.

On June 3-4, 2006, a Southern Luzon Summit was held at Daet, CNorte which was attended by 34 chapters in Bicol, PCC Officers of Laguna and Quezon provinces. Also on the activity, A MEMORANDUM OF AGREEMENT BETWEEN TRAFFIC MANAGEMENT GROUP  REGION 5 REPRESENTED BY P/SUPT. RUDY VALORIA AND GOVERNOR JENNIS NIDEA WAS SIGNED.

On June 17, 2006, Nidea KB Bicol Governor was invited by Office of Civil Defense Bicol for a brainstorming for a possible signing of MOA UNDER THE OCD-AUXILLIARY COMMUNICATION TEAM.

On July 5, 2006, KB Bicol led by Nidea was invited by the Regional Disaster Coordinating Council (RDCC) Bicol and OCD during the launching of Disaster Month Observance highlighted by a disaster preparation drill AND MOA SIGNING BETWEEN OCD REPRESENTED BY REGIONAL DIRECTOR ARNEL CAPILI AND KB BICOL REPRESENTED BY NIDEA.

On July 17, 2006, Nidea discovered an attempt by Dela Torre to register with the SEC a new   GROUP OF ENVIRONMENTALISTS USING A CORPORATE NAME AS KABALIKAT CIVICOM, INC.  Nidea sent a letter to SEC Manila protesting the use of Kabalikat Civicom by Mr. Dela Torre as its corporate name.

On July 31, 2006 when surfed at the SEC website, the reserved corporate name KABALIKAT CIVICOM INC. was already deleted in the reserve list but discovered another corporate name: KABALIKAT CIVIC COM PHILS being reserved by a certain Cherry Balboa of Kalookan City. So on August 4, Nidea again sent a letter of protest to SEC Manila.

On August 23, Nidea received a letter from SEC for a meeting, re: about protest vs. dela Torre and Balboa..

On August 24, at exactly 1 pm Nidea presented himself to Atty. Cape, in-charge of the case but the other parties did not showed up.  We waited until 4:00 pm but there were no dela Torree and Balboa.  When I told Atty. Cape that in his letter to me, failure on my side to attend said meeting, no action will be taken on my protest.  Now that the other parties did not show up, their application for registration must be denied.  Atty. Cape told me that he will give a chance to Mr. dela Torre.  Atty. Cape also Nidea that he believed that dela Torre and Ms. Balboa is just one group.

On September 26, 2006, another meeting was held.  This time delaTorre is present.  When Atty. Cape asked dela Torre about cherry Balboa, the latter answered: "I don’t know her". When we were in a conference room, Atty. Cape again asked dela Torre about Balboa, he said: "Ah, Naalala ko na Atty. Iyan yung babaeng nakilala ko sa ibaba ng bldg. [parang fixer] na nagpakilala na nag-aayos ng mga papers sa mga gusting magrehistro." And then later, for the 3rd time, Atty. Cape asked dela Torre if he can represent Ms. Balboa? He replied: "Ah OO kasi miembro din and I just gave her an authorization to register the KABALIKAT CIVIC COM PHILS.

Dela Torre told Atty. Cape HE WILL NOT PURSUE the application for registration for KABALIKAT CIVICOM INC. which was reserved last June 22, 2006 by him and instead he pursue the application for registration of KABALIKAT CIVICOM PHILS which  was reserved by Ms. Balboa..

Finally, we were asked to submit our respective position paper on or before October 26, 2006 before deciding on the case.
